New Year Violence UP!

New Year violence was up throughout New Zealand, though the police suppressed most of the news

Nelson police reported:

  • Three rapes
  • One stabbing
  • 59 people were arrested
  • An attempted murder
  • An indecent assault
  • Three counts of male assaults female
  • Two common assaults

Those were the stats for last night. “I am also expecting further reported offences to be made this morning when partygoers awake.” A policeman said.

Total number of revelers were about 3,000.

Elsewhere:

More than 200 people were arrested at Whangamata and Whitianga.

There were hundreds of arrests in other areas too, but the police declared that the revellers nationwide had largely behaved themselves. What double speak!

New Zealand Prosecutors the Dumbest in the World

‘I would never have my genitals pierced,’ thought Alice, ‘unless of course I wanted to be touched inappropriately.’

Your honor, the defendant touched the plaintiff’s genitals inappropriately as he proceeded to perform urethral piercing on her at the victim’s request!

Assuming the ‘victim’ didn’t intend to catch two fish with one lure [readers excuse the olefactory reference,] paying only once for receiving two services, how could anyone have her genitals pierced without the said flesh being touched ‘inappropriately.’

Oh, and there was one jury who was even dumber than the prosecutor:

Body piercer acquitted of indecent assault

A French body piercer has been acquitted on charges of inappropriately touching two female Nelson clients.

Vincent Jean Delebecque, 25, was facing three charges of indecent assault, two involving one woman and a third involving another.

He was last night acquitted by a jury after a two-day trial.

The Crown had alleged that Delebecque touched the women inappropriately while working as a body piercer at Gizmos in Nelson.

The Crown said Delebecque put his hand down a 16-year-old’s pants while she was getting a piercing done in a tattoo on her hip in March, and that he indecently assaulted a 24-year-old woman who went to Gizmos to get her genitals pierced in April.

Defence lawyer Tony Bamford said in his closing that the complaints against Delebecque had to be seen in context.

Mr Bamford said Delebecque denied that the first alleged incident happened. However, the second witness was having a very intimate procedure done, and he had to touch her in an intimate place to carry it out.

The complainant had never had a piercing of that type done before and did not know what to expect, Mr Bamford said.

He said the alleged indecent had to be seen in context. The reason for the touching was to show her the different purposes of the jewellery.

The next alleged incident of inappropriate touching involving that witness was accidental, he said.

Crown prosecutor Craig Stevenson told the jury Delebecque’s behaviour was unprofessional and illegal.

Mr Stevenson said the similarities between the two complainants, who were unknown to each other, made their allegations more reliable.

In summing up, Judge Tony Zohrab said that while body piercing was likely to be something the jurors were not too familiar with, they needed to put aside any prejudice they had over the complainants getting piercings, and the accused choosing it as a career.

The jury was sent out to deliberate at 5pm last night, and returned its verdicts four hours later.

Delebecque was found not guilty on two charges – the single charge against the now-17-year-old and one against the 24-year-old – by an 11 to one majority, while the third not guilty verdict was unanimous.

It is the first time a majority verdict has been reached in Nelson since that option was introduced.  © 2009 Fairfax New Zealand Limited

pakeha Defence Force spokesman Bas Bolyn said the scumbag would be tried on seven charges, including

  • Assault by a male on a female [Yes, the same as Tony Veitch!]
  • Indecent assault
  • Doing an act likely to prejudice service discipline [Are you kidding? ]
  • Sodomy

“The court martial would be held at Trentham Military Camp, north of Wellington, on April 27 and was expected to take three days,” the advertising media reported Bas Bolyn as saying.

[What does Bas stand for? Is it short for Bas***?]

The unnamed scumbag, if found guilty, automatically qualifies to join the SIS!

Church pays big money to lawyers to fight criminal charges

In 2003-2006, the Catholic order of St John of God Brothers spent up to a million dollars in legal fees, trying to save three of its members being extradited from Australia to face trial in New Zealand on child-sex charges. This is money that could otherwise have been spent on providing rehabilitation for people who have suffered in St John of God (SJOG) institutions in Australia and New Zealand. The SJOG order has specialized in accommodating boys and young men who have intellectual or learning disabilities.

In 2003 a New Zealand court issued a warrant to have the three SJOG members extradited to New Zealand. The three, who were living in Sydney in 2003, were:

  • Brother Rodger William Moloney, then 69;
  • Father Raymond John Garchow, then 57; and
  • Brother William John Lebler, then 83. [Oh, Brother!]

Snail-pace justice

Church lawyers, who were being paid by the St John of God order, appealed to the Australian Federal Court against the extradition order.

On 15 April 2005, Federal Court judge Rodney Madgwick reserved his decision on the appeal. Justice Madgwick said it would take some time for him to prepare a judgment. And His Honour was correct – twelve months later, on 15 April 2006, the judgment had not yet appeared. Nobody had expected that His Honour would take a year. [WTF]

Million-dollar justice

The head of the SJOG order for Australia and New Zealand (Brother Peter Burke) admitted to the media that the SJOG order was paying the men’s legal fees. He would not say how much had been spent. But because the extradition case had been running for a long time it was substantial, he said, and he had sought guidance from Rome [Vatican, the Pope] on the cost. Legal observers estimated that, by the end of 2006, the SJOG order had spent as much as $1,000,000 Australian on this case.

However, Broken Rites questions the propriety of this legal support. One million dollars would be better spent in creating supports to people damaged by sexual abuse. SJOG victims need education, housing and help in maintaining relationships, as they have few social skills. These people need some sort of place they can go to learn the social and vocational skills they need to function in society.

Man tells of ‘touching’ in dormitory

Moloney, 73, is accused of abusing 11 boys over a six-year period.

He denies 14 charges of inducing an indecent act, 10 of indecent assault, four of sodomy and two of doing an indecent act.

The man said Moloney had told him not to tell anyone about the incidents.

He had not told anyone until a television programme alleging another member of the order, Brother Bernard Kevin McGrath, had abused other boys, prompted him to tell his mother it had also happened to him.

McGrath has already been tried and was jailed for five years in 2006 on 21 charges of sexual offending against children at the school between 1974 and 1977.
